TERMS AND CONDITIONS

These terms and conditions apply to all offers, orders, agreements and deliveries made by SchoneMond Experience, part of Claudia Smile, through its website and online shop.
By placing an order, the consumer confirms that they have read and accepted these terms and conditions.

2. Applicability
These terms and conditions apply to every offer made by SchoneMond Experience and every agreement concluded through the website or online shop.
Any departure from these terms is valid only if agreed in writing.
Should one or more provisions prove void or voidable, all remaining provisions will remain fully effective.
3. Definitions
For the purposes of these terms and conditions:
Trader: SchoneMond Experience, part of Claudia Smile.
Consumer: a natural person acting for purposes outside their trade, business or profession.
Agreement: the agreement concluded between SchoneMond Experience and the consumer through the online shop.
Product: any item offered through the online shop.
Website: the SchoneMond Experience website, including the online shop.
4. Offers
SchoneMond Experience takes the greatest possible care when preparing its website and product information.
Obvious mistakes, typographical errors or manifest errors in prices, images or product descriptions are not binding on SchoneMond Experience.
Images are provided for illustration only. Minor variations in colour or products may occur.
Unless expressly stated otherwise, all offers are subject to availability.
5. Formation of the agreement
An agreement is formed once the consumer places an order and SchoneMond Experience confirms that order electronically.
SchoneMond Experience may refuse an order where reasonable grounds exist, including an obvious error, payment problems or suspected fraud.
After the order has been received, the consumer will receive an order confirmation by email.
6. Prices
All prices displayed on the website include VAT unless expressly stated otherwise.
Any delivery charges are clearly displayed before the consumer places the final order.
SchoneMond Experience may change its prices. Price changes do not affect agreements already concluded.
Obvious pricing or technical errors are not binding on SchoneMond Experience.
7. Payment
Payment must be made using one of the methods offered during checkout.
The agreement will be performed once payment has been successfully processed, unless expressly agreed otherwise.
If payment is refused or cancelled, SchoneMond Experience may decline to fulfil the order.
8. Delivery
SchoneMond Experience aims to process and dispatch orders as quickly as possible.
The stated delivery times are estimates and do not constitute binding deadlines.
If delivery is delayed, the consumer will be informed as soon as possible.
SchoneMond Experience delivers to consumers in the Netherlands and other European Union countries.
9. Delivery charges
Any delivery charges are clearly stated before the consumer completes the order.
Where free delivery is offered, its conditions are clearly explained on the website.
10. Retention of title
All products supplied remain the property of SchoneMond Experience until full payment has been received from the consumer.
11. Product availability
SchoneMond Experience aims to keep stock information up to date.
If an ordered product unexpectedly becomes unavailable, the consumer will be informed as soon as possible.
The consumer is then entitled to a refund of any amount paid or, if desired and agreed by the consumer, a suitable alternative.
12. Performance of the agreement
SchoneMond Experience will perform the agreement to the best of its knowledge and ability.
Where necessary for proper performance, SchoneMond Experience may engage third parties to carry out particular services or aspects of delivery.
13. Right of withdrawal
The consumer may withdraw from an online purchase without giving a reason within fourteen (14) days of receiving the product.
To exercise the right of withdrawal, the consumer must send SchoneMond Experience an unequivocal statement within that period.
After notifying us of withdrawal, the consumer has a further fourteen (14) days to return the product.
14. Conditions for returns
During the cooling-off period, the consumer must handle the product and its packaging with care.
The product may only be unpacked or used as necessary to establish its nature, characteristics and functioning.
If the product is used beyond what is necessary, the consumer may be charged for any resulting reduction in value.
The consumer is responsible for packaging the returned product carefully.
15. Exceptions to the right of withdrawal
The right of withdrawal does not apply to products exempted by law, including:
- sealed products unsuitable for return for health-protection or hygiene reasons where the seal has been broken after delivery;
- products made to the consumer’s specifications;
- other exceptions listed in Article 6:230p of the Dutch Civil Code.
16. Refunds
After receiving and inspecting the returned product, SchoneMond Experience will refund the amount due, including any standard delivery charge paid for the original delivery, as soon as possible and no later than fourteen (14) days.
SchoneMond Experience may withhold reimbursement until the returned products have been received or the consumer has provided proof of dispatch, whichever occurs first.
Refunds are issued using the original payment method unless expressly agreed otherwise.
17. Return costs
Unless expressly stated otherwise on the website, the consumer bears the direct cost of returning a product.
If SchoneMond Experience supplied the wrong product or a damaged product, it will cover the return costs.
18. Statutory guarantee and conformity
SchoneMond Experience guarantees that supplied products conform to the agreement, meet the consumer’s reasonable expectations and comply with the legislation applicable at the time of delivery.
If a product does not conform to the agreement, please notify us as soon as possible after discovering the issue.
Depending on the circumstances, SchoneMond Experience will repair or replace the product or, where this is not reasonably possible, refund all or part of the purchase price.
This guarantee does not affect the consumer’s statutory rights.
19. Complaints procedure
We aim to maintain high customer satisfaction. If you nevertheless have a complaint, please let us know as soon as possible.

We aim to acknowledge every complaint within five (5) working days and provide a substantive response within fourteen (14) days.
If additional time is needed, we will inform you promptly of the expected resolution date.
20. Liability
SchoneMond Experience is liable only for direct loss resulting directly from an attributable breach or unlawful act, insofar as such liability cannot lawfully be excluded.
All liability for indirect loss, including consequential damage, lost profits, missed savings, business interruption and other indirect losses, is excluded unless caused by intent or wilful recklessness.
To the extent permitted by law, liability is limited to the price paid for the relevant product or, where applicable, the amount paid out under the liability insurance policy.
21. Force majeure
SchoneMond Experience is not obliged to fulfil an obligation where performance is impossible due to force majeure.
Force majeure includes:
- internet or telecommunications outages;
- government measures;
- strikes;
- pandemics;
- natural disasters;
- transport problems;
- disruptions affecting suppliers or logistics partners;
- other circumstances beyond the reasonable control of SchoneMond Experience.
Obligations are suspended for the duration of the force majeure event.
If the event lasts more than thirty (30) days, either party may terminate all or part of the agreement without any obligation to pay compensation.
22. Intellectual property
All website texts, images, logos, trade names, designs, product information and other content belong to SchoneMond Experience or are used with the rights holder’s permission.
Website material may not be copied, published, distributed or otherwise used, in whole or in part, without prior written permission, unless permitted by law.
23. Privacy
SchoneMond Experience processes personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR).
Further information is available in the Privacy Policy on our website.
24. Governing law
All agreements, offers and these terms and conditions are governed exclusively by Dutch law.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
Disputes will be submitted to the competent court in the Netherlands unless mandatory legal provisions require otherwise.
25. Amendments to these terms and conditions
SchoneMond Experience reserves the right to amend or supplement these terms and conditions.
The current version is always available on the website.
Agreements already concluded remain subject to the terms and conditions applicable when they were formed, unless the law provides otherwise.
26. Final provisions
If one or more provisions of these terms and conditions prove wholly or partly invalid or are annulled, the remaining provisions will remain fully effective.
The parties will replace any invalid or annulled provision with one that reflects its original purpose and intent as closely as possible.
